El Poder Judicial de (\u00c1ncash) <\/strong>confirm\u00f3 la pena de seis a\u00f1os de c\u00e1rcel que se le impuso al mal efectivo en primera instancia.<\/h1>\n

La Segunda Sala Penal de Apelaciones de la\u00a0Corte Superior de Justicia<\/a>\u00a0del Santa (\u00c1ncash) confirm\u00f3 la sentencia de seis a\u00f1os de c\u00e1rcel en contra del expolic\u00eda Jhonny Leonidas Quispe Mata, quien fue denunciado por sustraerle a un mototaxista 200 soles de su billetera porque \u00e9ste solo estaba dispuesto a darle 15 soles para que no le imponga una papeleta por manejar en presunto estado de ebriedad.<\/strong><\/p>\n

Los magistrados declararon infundada la apelaci\u00f3n presentada por la defensa de Quispe Mata, contra el fallo que lo conden\u00f3 a seis a\u00f1os de c\u00e1rcel, por el\u00a0delito de cohecho pasivo propio en la funci\u00f3n policial en agravio del Estado.<\/p>\n

Seg\u00fan se relata en el expediente judicial, el 8 de abril de 2019, Quispe Mata fue intervenido por sus propios colegas, en el distrito de Moro,\u00a0tras ser denunciado por un mototaxista a quien le exigi\u00f3 una coima a cambio de no imponerle una papeleta de tr\u00e1nsito por conducir en estado de ebriedad.<\/p>\n

En ese momento, el conductor le manifest\u00f3 que solo ten\u00eda 15 soles,\u00a0el mal polic\u00eda no solo no quiso aceptar ese monto, sino que le quit\u00f3 su billetera y le sustrajo 200 soles. El hecho ocurri\u00f3 en el asentamiento humano Nuevo Moro.<\/strong><\/p>\n

Tras lo ocurrido, el mototaxista agraviado hizo la denuncia correspondiente y se procedi\u00f3 a la detenci\u00f3n del efectivo, quien, actualmente, se encuentra recluido en un centro penitenciario.<\/p>\n

Tras el juicio oral, el\u00a0Sexto Juzgado Unipersonal de la Corte Superior de Justicia del Santa\u00a0sentenci\u00f3 al suboficial de la PNP a seis a\u00f1os de c\u00e1rcel y le impuso cinco a\u00f1os de inhabilitaci\u00f3n para ejercer cualquier cargo p\u00fablico; as\u00ed como el pago de 6 mil soles como reparaci\u00f3n civil a favor del Estado.<\/p>\n

Con un fallo en contra, el abogado defensor de Jhonny Leonidas Quispe Mata plante\u00f3 un recurso de apelaci\u00f3n, aduciendo que la sentencia no fue debidamente motivada ni argumentada. A pesar de ello, la\u00a0Segunda Sala Penal de Apelaciones\u00a0decidi\u00f3 confirmar el fallo condenatorio en todos sus extremos.<\/p>\n
